Terms of Service

Please read these Terms of Service ("Terms", "Agreement") carefully before using the SalesDoctor.ai platform ("Service") operated by SalesDoctor Inc. ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. This Agreement applies to all visitors, users, and others who access or use the Service.

2. Description of Service

SalesDoctor.ai is a Revenue Operating System designed for healthcare clinics, medspas, and aesthetic practices. We provide automated patient intake, booking management, and revenue analytics tools. We are a software provider, not a medical provider. We do not provide medical advice, diagnosis, or treatment.

3. Eligibility

The Service is intended solely for use by authorized representatives of healthcare clinics and agencies. By using the Service, you represent and warrant that you have the authority to bind the business entity you represent to these Terms.

4. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

5. Fees and Payments

  • Subscription Plans: We offer two primary subscription tiers:
    • The AI Receptionist (Core): $299/month. Includes unified inbox, basic automation, and booking tools.
    • Full Growth Management (Partner): $1,500/month. Includes advanced ads management, creative strategy, and priority support.
  • Payment Terms: SaaS fees are billed monthly in advance via Stripe. You authorize us to charge your payment method on file.
  • Patient Deposits: Deposits collected from patients are processed via Stripe Connect and routed directly to your connected bank account. SalesDoctor.ai does not hold or touch patient funds.
  • Taxes: You are responsible for all applicable taxes associated with your use of the Service.

6. Cancellation & Refund Policy

You may cancel your subscription at any time via your dashboard or by contacting support. SaaS fees are non-refundable. We do not offer prorated refunds for partial months of service. Patient deposit refunds are at the sole discretion of the Clinic, subject to your own refund policies.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SalesDoctor Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

8. User Content & Data

You retain all rights to the data, patient records, and content you upload to the Service ("User Data"). By using the Service, you grant us a worldwide, non-exclusive license to access, use, process, copy, distribute, perform, export and display User Data only as reasonably necessary to provide, maintain and improve the Service.

9. HIPAA Compliance & Patient Data

If you are a Covered Entity under HIPAA, we act as your Business Associate.

  • Business Associate Agreement (BAA): We will enter into a BAA with you to ensure the protection of Protected Health Information (PHI).
  • Security: We implement industry-standard security measures (AES-256 encryption) to protect PHI.
  • Responsibility: You are responsible for obtaining all necessary patient consents and authorizations for the use of their data within our platform.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. SalesDoctor.ai makes no representations or warranties of any kind, express or implied, regarding the use or the results of this Service in terms of its correctness, accuracy, reliability, or otherwise. We do not guarantee that the Service will result in increased revenue or bookings.

11. Limitation of Liability

In no event shall SalesDoctor Inc., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

12. Indemnification

You agree to defend, indemnify and hold harmless SalesDoctor Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

13. Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration in the State of Delaware, in accordance with the rules of the American Arbitration Association.
